2What Is a Takedown Notice?

A takedown notice is a formal request from a copyright owner (or their authorised representative) asking us to remove or disable access to specific material that allegedly infringes their copyright. This process is modelled on the notice-and-takedown framework established by the U.S. Digital Millennium Copyright Act (DMCA), which is widely used internationally as a practical standard for handling these requests — see Section 9 for how this applies in an Australian context.

5What Happens After We Receive a Notice

Upon receiving a complete and valid notice, we will:

• Review the notice to confirm it meets the requirements in Section 3.
• Remove or disable access to the identified material as promptly as reasonably possible.
• Notify the affected user (where applicable) that content has been removed in response to a copyright claim, along with a copy of the notice.
• Document the notice and our response for our internal records.

6Counter-Notification

If you believe material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent, including:

• Identification of the material removed and its location before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location.
• Your physical or electronic signature.

Upon receiving a valid counter-notification, we may restore the material after a reasonable period, unless the original complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.

7Repeat Infringer Policy

In appropriate circumstances, we will terminate the accounts of users who are found to be repeat infringers of copyright, in accordance with our Terms of Service.

9A Note on Jurisdiction

While this policy is modelled on the DMCA notice-and-takedown framework as a widely recognised international standard, IPTV Australia operates under Australian law, including the Copyright Act 1968 (Cth). We apply the process in this policy to all copyright complaints regardless of the complainant's location, as a consistent and practical way to handle infringement reports.
